This website is operated by Alcateia Brazilian Jiu Jitsu. Throughout the site, the terms “we”, “us” and “our” refer to Alcateia Brazilian Jiu Jitsu. Alcateia Brazilian Jiu Jitsu offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

Our website, subscription options, and store is hosted on Wix.com. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

SECTION 1 - ONLINE STORE AND MEMBERSHIP SUBSCRIPTION TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited.

We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel subscriptions, quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 17 - ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

Alcateia Brazilian Jiu Jitsu respects the private and confidential nature of information received. The purpose of the Privacy Policy is to explain how Alcateia Brazilian Jiu Jitsu will collect, use and disclose

personal information on the Alcateia Brazilian Jiu Jitsu website (“the website”). Further, this Privacy Policy details the manner in which Alcateia Brazilian Jiu Jitsu will comply with all federal and provincial privacy legislation requirements.

This Privacy Policy may be updated or amended so as to take into account changes in business

practices, technology or laws. Your use of the website following any such changes constitutes your

agreement to follow and be bound by the updated terms of the Privacy Policy. The owners and staff of Alcateia Brazilian Jiu Jitsu will review this process regularly to ensure compliance with the law.

Communicate online with our owners or representatives.

By signing into our website using a third party social media platform such as Facebook, YouTube, twitter, Instagram, Snapchat, etc. you may give Alcateia Brazilian Jiu Jitsu permission to access your information in such other services. By linking your Alcateia Brazilian Jiu Jitsu account to these social media platforms Alcateia Brazilian Jiu Jitsu will be permitted to obtain certain information from these accounts. This information could include your public profile, friends list, e-mail address, birthday, interests, personal description, likes and dislikes and previous posts/tweets among other things. The information obtained from these social media platforms depends on your account privacy settings and is not controlled by Alcateia Brazilian Jiu Jitsu.

The website may contain links to other websites which are not operated by Alcateia Brazilian Jiu Jitsu and Alcateia Brazilian Jiu Jitsu has no responsibility for, or the control over those websites or the manner in which they collect or use personal information. Alcateia Brazilian Jiu Jitsu is strongly committed to protecting the personal information of all members and visitors to its website and particularly children under the age of 18. Parents and legal guardians are however advised and strongly encouraged to monitor their children’s use of the internet.

SECTION 7 – ANTI-SPAM LEGISLATION

Alcateia Brazilian Jiu Jitsu is committed to meeting the requirements of the Canada’s Anti-Spam Legislation. You may, therefore “unsubscribe” from receiving any communications from Alcateia Brazilian Jiu Jitsu at any time and your e-mail address will be removed from our mailing list and database.

SECTION 8 – RETENTION OF PERSONAL INFORMATION

Alcateia Brazilian Jiu Jitsu will retain your personal information only as long as it is necessary to fulfill the identified purposes or a legal or business purpose in accordance with this Privacy Policy. Alcateia Brazilian Jiu Jitsu maintains appropriate procedural and technological measures and storage facilities to prevent any unauthorized use or disclosure of your personal information. We cannot, however, guarantee the security of any personal information provided to us in an e-mail or in online form while it is being transmitted to us, as the internet is a potentially non-secure method of information transfer. All matters relating to the access of the Alcateia Brazilian Jiu Jitsu website, including all disputes shall be governed by the laws Canada and of the province of Ontario.

MEMBERSHIP DUES AND SUBSCRIPTIONS POLICY – ALCATEIA BRAZILIAN JIU JITSU

SECTION 1 - MEMBERS SUBSCRIPTIONS AND CLUB DUES POLICY:

No person will participate in activities of Alcateia Brazilian Jiu Jitsu without having first completed a release of liability waiver.

If you decide to join, members are required to register with the Ontario Jiu Jitsu Association (OJA) annually, for insurance purposes, and must show proof of membership by joining the academy through the Smoothcomp website linked to your OJA membership. Your OJA membership provides you with insurance for your participation in sanctioned Ontario Jiu Jitsu activities, like classes with Alcateia Brazilian Jiu Jitsu, and at events, such as Ontario tournaments. You must notify Alcateia Brazilian Jiu Jitsu of any insurance claims made through the OJA in relation to activities with Alcateia Brazilian Jiu Jitsu.

Class membership fees are paid bi-weekly and are charged to your credit card on a recurring basis or you may pay by cash or e-transfer manually on a non-recurring basis. Membership prices are specifically outlined in the website members section and are charged bi-weekly. We offer discounted options to Crossfit Belleville members, first responders (police, fire, and EMS), active military, and families, when more than one person from the same household want to participate in classes together.

When you purchase a membership subscription for a 2-week period you will be entitled to attend scheduled classes for the following 2-week period after the payment.

Alcateia Brazilian Jiu Jitsu reserves the right to set the class schedule and modify the schedule as required.

If you do not attend a scheduled class that you are entitled to attend you are not entitled to refunds, reimbursements or discounts resulting from you not attending the class. You can cancel future bi-weekly subscriptions payments at any time, particularly in cases where you require a pause in your membership to avoid future unwanted charges.

All Membership Subscription Sales are final and are non-refundable provided that services were offered as advertised.

If you select a discounted membership, Alcateia Brazilian Jiu Jitsu will determine and confirm you meet the requirements to be granted this membership type. You should attempt to confirm if you qualify before subscribing to avoid penalties and administrative fees resulting from having to reorganize your membership.

If you have paid for a membership type and it is determined that you do not meet the requirements of that membership type, it will be cancelled and rebilled under the appropriate plan and you are responsible for any additional cost associated with re-arranging your membership, such as cancellation and administrative fee related to the first payment.

In accordance with the liability waiver and Terms of Service, Alcateia Brazilian Jiu Jitsu also has the right to revoke a membership and participation in its activities, without refund, if you fail to follow directions or rules set out by the staff.

SECTION 2 - VISITOR'S SUBSCRIPTIONS AND DUES POLICY:

No person will participate in activities of Alcateia Brazilian Jiu Jitsu without having first completed a release of liability waiver.

Visitors are encouraged to register with the Ontario Jiu Jitsu Association (OJA) annually, for insurance purposes. Your OJA membership provides you with insurance for your participation in sanctioned Ontario Jiu Jitsu activities, like classes at Alcateia Brazilian Jiu Jitsu, and at events, such as Ontario tournaments. If you are not an OJA member you will not be able to make any insurance claims as a result of your participation of any activities at Alcateia Brazilian Jiu Jitsu.

Visitor fees paid are for participation in one class only for persons who are not members or prospective members of Alcateia Brazilian Jiu Jitsu. Your visitor fee may be applied to one scheduled class within one week after payment. A maximum of three visitor subscriptions are permitted in a one month period, otherwise you must purchase a bi-weekly membership.

All sales are final we do not offer refunds on paid membership subscriptions which include visitor subscription fees.

In accordance with the liability waiver and Terms of Service, Alcateia Brazilian Jiu Jitsu also have the right to revoke you from participating, without refund, if you fail to follow directions or rules set by the staff.

STORE REFUND POLICY – ALCATEIA BRAZILIAN JIU JITSU

We have a 7-day return policy, which means you have 7 days after receiving your item to request a return.

To be eligible for a return, your item must be in the same condition that you received it, unopened, unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.

To start a return, please contact us at alcateiabjjbelleville@gmail.com. Please note that return costs are the responsibility of the buyer, except in the event of damaged/defective items. Returns will need to be brought to class and given to a staff member.

If your item is damaged or defective, bring the item to class and give it to a staff member.

Damages and issues

Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right. Damaged items must be reported within 48 hours of receipt in order to be eligible for free returns.

Exceptions / non-returnable items

Unfortunately, we cannot accept returns on sale items.

Exchanges

The fastest way to ensure you get what you want is to return the item you have, and once the return is accepted, make a separate purchase for the new item. You may be charged for shipping costs associated with sending the item back to our supplier.

Refunds

We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method within 10 business days. Please remember it can take some time for your bank or credit card company to process and post the refund too.

Cancellations

Cancelled orders are subject to a 2% transaction fee.

If your order hasn’t shipped yet and you wish to cancel, please get in touch with us as soon as possible at alcateiabjjbelleville@gmail.com as we may be able to cancel it prior to shipping.

Preordered items have a 24 hour window for cancellation. After 24 hours have passed from the time you initially placed your preorder, you can no longer cancel it. As preorder items are made specifically for you, we are unable to cancel those orders. If after you receive it you wish to return it, our standard return rules apply.
